Pa. Commonwealth Court strikes down ban on Medicaid for abortion

The Commonwealth Court of Pennsylvania has ruled that the state's ban on public funds for abortion care is unconstitutional. The law, which prevents the use of public funds from programs such as Medicaid on abortion, was challenged by a group of medical care providers in 2019. The court found that the law violates the Equal Rights Amendment of the Pennsylvania Constitution. In the majority opinion, Judge Mathew S. Wolf stated that the amendment guarantees a fundamental right to reproductive autonomy and requires proper scrutiny. The dissenters accused the majority of approving abortions on-demand.
