US Supreme Court scrutinizes gun ownership ban for illegal drug users

The US Supreme Court is reviewing a decision to dismiss an illegal gun possession charge against American-Pakistani dual citizen Ali Hemani, who told authorities he was a regular marijuana user. Hemani was charged in 2023 under a 1968 federal law that makes possession of a firearm illegal for anyone who is an unlawful user of or addicted to any controlled substance. The Justice Department has appealed the decision, arguing that the law's reference to an "unlawful user" is unconstitutionally vague. The 5th U.S. Circuit Court of Appeals dismissed the charge in January, stating there is no historical justification for disarming a sober citizen not currently under an impairing influence. The Supreme Court has traditionally taken an expansive view of Second Amendment protections.
