The U.S. government is claiming that toxic exposure from the 2021 Red Hill fuel leak was related to military service, but service members suing the government argue this is wrong. At least 1,000 active-duty military members have filed claims against the federal government after becoming sick following the fuel leak. The government argues that the incident was an occupational hazard and therefore bars active service members from suing for injuries. The attorney representing the service members, Kristina Baehr, states that the exposure occurred at home, not on duty. The court awarded damages for representative plaintiffs four years after the litigation began, but the government now pays $0.
